User Agreement Notice to customers: Dial-up accounts are
sold as single user accounts only. This
means that the account is to be used by only one person. Auto re-dialers are NOT to be used. Any attempt to use a dial-up account as a network connection
will result in being billed for a 24 hour account, with NO exceptions and
NO prior warnings. Excessive
use of system resources is prohibited. This primarily prohibits the
continued usage of a dial-up port to simulate a dedicated connection for
the user’s system. Dial-up
accounts are designed to provide on-demand access for account holders, not
dedicated connections. If you
have any questions or concerns with our policy, please make sure to
contact us prior to setting up service. DSL basic accounts are for individual use only. Any attempt to use an DSL account to running any type of server, sharing software or using excessive system resources will result in being billed for the excessive resource or termination of the account, with NO exceptions and NO prior warnings. Specialists, Inc (hereafter referred to as MSI) agrees to provide Internet
access, web hosting, and all other services provided to it’s customers
under the following conditions: Customers are
responsible for backing up data.
MSI is not responsible for any lost or corrupted files, including,
but not limited to, email, graphics, and html or database files. Account holders are
responsible for protecting their own passwords. Storage space is for
personal files only. This
is primarily for, but not limited to, HTML and web-based documents and
files that can be viewed using
a web browser or similar application.
Customers storing files of a commercial nature on MSI’s service
agree to be billed according to the commercial web page pricing schedule.
MSI is the sole judge of what is or is not a commercial file.
Any questions relating to the matter should be addressed to a MSI
representative. Unacceptable Use It is not acceptable to
use inetMSI.net so as to interfere with or disrupt network users, services
or equipment. Such
interference includes, but is not limited to: distribution of unsolicited
advertising, propagation of computer worms or viruses and using the
network to make unauthorized entry to other computational, informational
or communications devices or resources. Prohibited Activity Attempts to compromise
system and/or network security- Programs such as packet sniffers, password
crack programs, and similar utilities found to be running from a user’s
account are prohibited. This
also includes attempts to hack into non-MSI systems. Sharing of a user’s
account with another party for purposes of avoiding payment for a second
account is strictly prohibited. MSI reserves the right
to edit and/or delete any files on our service at any time. MSI is not responsible
for any losses incurred by our customers due to disruption of service. MSI reserves the right
to change pricing and/or services offered at any time. MSI is not responsible
for any long distance charges incurred while using our service. Customers are solely
responsible for keeping the payment of their accounts current and up to
date. E-Mail abuse is
prohibited. E-mail abuse
typically comes in one of four forms; the transfer of a message to
unsolicited individuals, the sending of harassing and/or threatening
messages to other users, the forging of e-mail addresses so as to make the
e-mail appear to be from another user and sending bulk electronic mail
(SPAM). The accountholder
agrees to reimburse MSI for any and all expenses incurred by MSI as a
result of e-mail abuse by the accountholder; including, but not limited
to, legal fees and other expenses arising from the collection of such
reimbursement. Pirated software is
prohibited. Pirated
software is defined as: “the illegal exchange of software via the
Internet for purposes of avoiding the purchase of said software by the
individuals involved. This
includes most commercial applications such as:
Adobe Photoshop, Illustrator, etc… Such activities are prohibited
by Federal law and are thus not allowed in any form on inetMSI.net.
Such prohibition also includes the unauthorized copying of
copyrighted material including: but not limited to, digitization and
distribution of photographs from magazines, books or other copyrighted
sources and copyrighted software. The
exportation of software or technical information in violation of U.S.
export control laws is strictly prohibited. Accountholders shall
not use inetMSI.net as the means to stalk others or to post, transmit or
originate any unlawful, threatening, abusive, hateful, defamatory, obscene
or pornographic communication. Any
communication where the message or its transmission of distribution would
constitute or encourage conduct that would constitute a criminal offense,
give rise to civil liability or otherwise violate local, state, national
or international laws is prohibited.
MSI is in no way
responsible for content on the Internet.
All the pages on the MSI web server are RASC rated such that all
pages are viewable by all ages. MSI
reserves the right, at its sole discretion, to terminate service at any
time for violation of any conditions of the agreement or any activity by
the accountholder determined not to be in the best interest of MSI or the
Internet community in general. MSI shall have a
broad authority to interpret and apply these policies. MSI shall also be entitled to modify or amend these policies
at any time.
DISCLAIMER OF WARRANTY MSI disclaims any and
all warranties, whether expressed or implied, with respect to Internet
access product provided by MSI, including any warranties of
merchantability or fitness for a particular purpose.
MSI specifically disclaims any warranty, whether expressed or
implied, with respect to the time in which it will take the accountholder
to gain access to the Internet through the inetMSI.net Internet product
(hereafter referred to as the
“product or service”). The
accountholder is hereby advised that he/she may receive a busy signal when
attempting to gain access to the Internet using MSI’s product.
MSI shall have no responsibility with respect to MSI’s Internet
product for consequential, exemplary or incidental damages including; but
not limited to, damages of loss of good will, work stoppage, computer
failure or malfunction, loss of profits or any and all other damages or
losses. The accountholder
acknowledges that by accepting MSI’s software and using MSI’s Internet
product, he/she is agreeing to be bound by the terms of this express
disclaimer of warranty. Usage of MSI’s
service constitutes acceptance of this agreement in full. Internet services
will automatically be suspended if account is not paid by the due date. Any Questions? Please
